These Terms and Conditions govern your use of the TAEX website and the purchase of digital artworks made available by TAEX ONE LTD. By accessing the website or purchasing any digital artwork, you agree to be bound by these Terms.

1. Definitions

‘Artwork’ means any digital artwork, image, animation, video, generative artwork or other digital creative content offered by TAEX.
‘Digital File’ means the downloadable or electronically delivered file containing the Artwork.
‘Website’ means the TAEX website and associated online sales platform.
‘Customer’, ‘you’ and ‘your’ mean the purchaser.
‘We’, ‘our’ and ‘us’ mean TAEX ONE LTD.

2. About TAEX

TAEX ONE LTD operates an online gallery specialising in digital artworks. Unless expressly stated otherwise, TAEX acts either as the seller of digital works or as the authorised representative of the artist or rights holder.

3. Acceptance of these Terms

By using the Website, creating an account or purchasing any Artwork, you confirm that you have read and accepted these Terms. If you do not agree, you must not use the Website.

4. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts.

5. Products

All products sold are digital content supplied electronically. No physical goods are supplied unless expressly stated.

6. Ordering

Orders are subject to acceptance. We may refuse or cancel an order where required by law, where pricing errors occur or where fraud is suspected.

7. Prices and Payment

All prices are available on request. VAT and taxes are applied where legally required. Payment must be received before delivery.

8. Delivery of Digital Files

Digital files are delivered electronically by download link, email or user account access. Delivery normally occurs shortly after payment, although delays may occur for technical reasons.

9. Licence

Purchase grants a limited, personal, non-exclusive, non-transferable, revocable licence to use the Artwork for private, non-commercial purposes only unless a separate written licence provides otherwise. Copyright and all intellectual property remain with the artist and/or rights holder.

10. Prohibited Uses

Without written permission you may not:

• reproduce or commercially exploit the Artwork;

• remove copyright notices;

• use the Artwork for AI training datasets unless expressly licensed.

11. Intellectual Property

All intellectual property rights remain vested in the artist or relevant rights holder. No ownership of copyright transfers through purchase.

12. Refunds

Because the products are digital content supplied electronically, cancellation rights may cease once download or delivery begins where permitted under the Consumer Contracts Regulations 2013 and where the Customer has expressly consented. Nothing excludes statutory rights under the Consumer Rights Act 2015 if digital content is faulty, not as described or not of satisfactory quality.

13. Technical Requirements

Customers are responsible for maintaining compatible hardware, software and internet access.

14. Website Availability

We do not guarantee uninterrupted availability and may suspend access for maintenance.

15. Limitation of Liability

Nothing excludes liability for death, personal injury, fraud or any liability that cannot legally be excluded. Subject to applicable law, our liability shall not exceed the purchase price paid for the relevant Artwork.

16. Privacy

Personal data is processed in accordance with our Privacy Policy.

17. Force Majeure

We shall not be liable for delays caused by events beyond our reasonable control.

18. Changes

We may amend these Terms from time to time. Updated versions become effective upon publication.

19. Governing Law

These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, subject to any mandatory consumer rights.
